📋 The Current Law

Mississippi has a universal motorcycle helmet law. Every person who operates or rides on a motorcycle or motor scooter on a Mississippi road or highway must wear a crash helmet of a type approved by the American Association of Motor Vehicle Administrators (AAMVA), regardless of age.

The Motorcycle Operator Manual notes that helmeted riders are three times more likely to survive head injuries, and that the single most important thing you can do to improve your chances in a crash is to wear a securely fastened, quality helmet (MOM 17th Ed., p.5).

🪖 Who Must Wear a Helmet

There is no adult exemption in Mississippi. If you are on a motorcycle — operating it or riding as a passenger — you must wear an approved helmet, at any age.

Because the law applies to everyone on the motorcycle, an operator is responsible for ensuring a passenger is also wearing an approved helmet.

⚠️ Penalties

Riding without a required helmet — or carrying a passenger who is not wearing one — violates Mississippi law and can bring a fine and other penalties. Confirm current fine amounts with the Mississippi Department of Public Safety.

👓 Eye Protection

Unlike many states, Mississippi law does not separately require eye or face protection. This is a genuine point of difference — but the Motorcycle Operator Manual still strongly advises it.

A plastic, shatter-resistant face shield helps protect your whole face; goggles protect only your eyes; and a windshield is not a substitute for either. Tinted eye protection should not be worn when little light is available (MOM 17th Ed., p.6).

✅ DOT-Approved Helmet Standards

A legal motorcycle helmet must meet the U.S. Department of Transportation (DOT) FMVSS 218 standard. Look for the "DOT" certification label on the back. Helmets that meet stricter Snell or ECE standards offer additional protection. Avoid novelty helmets — they are not legal head protection.
