📋 The Current Law

West Virginia has a universal motorcycle helmet law. Under W.Va. Code §17C-15-44, a person may not operate or be a passenger on a motorcycle or motor-driven cycle on a public road unless wearing protective headgear, regardless of age.

An approved helmet must meet the performance specifications of ANSI Standard Z90.1, U.S. DOT Federal Motor Vehicle Safety Standard No. 218, or the Snell Safety Standards for protective headgear. A licensed driver operating a fully enclosed autocycle is the only exemption.

🪖 Who Must Wear a Helmet

There is no adult exemption in West Virginia. Every operator and every passenger must wear an approved helmet, at every age.

A passenger may ride only on a motorcycle designed and equipped to carry more than one person — a proper seat and footrests — and must wear a helmet and eye protection just like the operator.

⚠️ Penalties

Operating or riding a motorcycle without the required helmet and eye protection violates W.Va. Code §17C-15-44 and is a traffic offense that can bring a fine and points on your record. Because the requirement applies to passengers as well, an operator can be responsible for an unprotected passenger. Confirm current fine amounts with the WV DMV.

👓 Eye Protection

West Virginia also requires eye protection for every operator and passenger: shatter-resistant safety eyeglasses, eye goggles, or a face shield that meets the ANSI Z2.1 specification. Contact lenses do not satisfy the requirement.

Unlike many states, West Virginia does NOT waive the eye-protection requirement when the motorcycle has a windshield — the eyewear is required either way. If the motorcycle is equipped with a windshield, that windshield must itself be made of safety, shatter-resistant material (W.Va. Code §17C-15-44).

✅ DOT-Approved Helmet Standards

A legal motorcycle helmet must meet the U.S. Department of Transportation (DOT) FMVSS 218 standard. Look for the "DOT" certification label on the back. Helmets that meet stricter Snell or ECE standards offer additional protection. Avoid novelty helmets — they are not legal head protection.

The pass standard is widely reported as 19 of 25 (76%) — unusually, not the common 80%; West Virginia publishes no official count, so this is third-party consensus.
