How to Get Your West Virginia Learner's Permit

A step-by-step guide to getting your West Virginia Learner License and moving through the GDL program to a full driver's license.

📋 West Virginia GDL Program Overview

West Virginia uses a three-tier Graduated Driver Licensing (GDL) program for drivers ages 15 to 17 (Level 1 instruction permit → Level 2 intermediate license → Level 3 full license). Each tier has its own requirements and restrictions. Adults 18 and over apply for the regular Class E instruction permit instead.

Level 1 GDL Instruction Permit

Minimum age: 15. Drive 5 a.m.–10 p.m. with licensed 21+ adult in right front seat; max 2 non-family passengers. Hold for 180 consecutive days conviction-free. Fee: $7.50.

Level 2 GDL Intermediate License

Age 16+. Drive alone 5 a.m.–10 p.m.; 21+ supervisor required 10 p.m.–5 a.m. First 6 months: no non-family passengers under 20. Second 6 months: max 1. Fee: $5.00 / year.

Level 3 GDL Full License

At age 17, after 12 conviction-free months at Level 2. All restrictions lifted. Drive for Five program — expires on birthday divisible by 5. Fee: $2.50 / year (under 18).

Meet the Age and School Requirements

Be at least 15 years old. Applicants under 18 must provide a valid School Driver Eligibility Certificate from their county school board (home-schooled and out-of-state students have separate procedures — see p. 5 of the handbook). A diploma or GED certificate substitutes if you have completed school.

Get Parental or Guardian Consent

A parent or legal guardian must sign form DMV-DS-23P to authorize issuance of the Level 1 GDL instruction permit. Married applicants under 18 are exempt if they present a certified marriage certificate.

Gather Your Documents

Each time you apply and test for the Level 1 permit, you must bring:

  • Certified U.S. birth certificate
  • Signed Social Security card from SSA (or SSA ineligibility letter)
  • Two (2) proofs of West Virginia residency (utility bill ≤90 days, tax record, bank statement, insurance card, W-2, etc. — NO PO Boxes)
  • Valid School Driver Eligibility Certificate (with physical address)
  • Parent/guardian consent form DMV-DS-23P

Pass the Vision Exam & Knowledge Test

Vision must be at least 20/40 in one eye (glasses or contacts allowed — adds corrective-lens restriction). The automated knowledge test has at least 25 questions; pass with 19 of 25 correct (76%). No phones, PDAs, Bluetooth, or electronic devices in the exam room.

Pay the Fees

The knowledge test is $7.50 per attempt. The Level 1 GDL instruction permit fee is $7.50. Add $10 for a REAL ID ("For Federal Use") card. The temporary license is issued at the office; the REAL ID arrives by USPS in 10–15 business days.

🚗 Level 2 — Getting Your Intermediate License (Age 16)

Meet Level 1 Requirements

Be at least 16 years old and have held your Level 1 instruction permit for a minimum of 180 consecutive days conviction-free immediately before applying for Level 2.

Complete 50 Behind-the-Wheel Hours

A parent or legal guardian must certify a driving log of 50 hours behind the wheel, including 10 hours at night. Alternatively, complete a driver education course approved by the WV Department of Education.

Pass the Road Skills Test at DMV

You have a maximum of 3 attempts at the road skills test. Bring your birth certificate, signed Social Security card, School Driver Eligibility Certificate, the 50-hour log, and all licensing documentation. The test includes basic control skills (parallel park, turnabouts) plus an on-road route.
