How to Pass the New Mexico MVD Written Test

The knowledge test trips up many first-time applicants. Here's exactly what to study and how to walk in prepared.

📋 Know the Test Format

The New Mexico MVD knowledge test is commonly 25 questions. You must score at least 80% to pass — meaning you need at least 20 correct and can miss up to 5. The NM Driver Manual does not fix the count; call MVD at 1-888-683-4636 to confirm the current format.

The NM Driver Manual does not publish a fixed retake policy. Field offices may allow same-day or next-day retests, typically with a small re-exam fee. Check mvd.newmexico.gov for the current retake schedule at your local office.

The NM MVD knowledge test is administered in person at an MVD field office. Many offices accept appointments; others allow walk-ins. Find your nearest location at mvd.newmexico.gov.

Applicants 15 or older who want an Instructional Permit must be enrolled in and attending an approved New Mexico driver-education course that includes DWI education and practice driving. The NM Driver Manual does not describe a waiver of the written test for completing driver education — contact MVD to confirm current policy.

DWI & BAC Limits

Drivers 21+ can be arrested for DWI at 0.08% BAC. Drivers under 21 can be arrested at 0.02% (Zero Tolerance). Refusing a BAC test costs you your license for one year under implied consent. Any DWI conviction stays on your record 25 years (Manual: Alcohol and the Law).

DWI Penalties

A 1st DWI brings stiff fines, court costs, possible jail, mandatory substance-abuse treatment, MVD license revocation, and an ignition-interlock device. Subsequent convictions bring increased fines, more jail time, and longer revocations. The NM Driver Manual does not publish exact dollar amounts — these are set by the sentencing court (Manual: Alcohol and the Law).

GDL — Instructional & Provisional License

Instructional Permit at age 15; hold 6 months with a supervising driver 21+ licensed 3+ years. Provisional License at age 15½ after 50 hrs practice (10 at night); midnight–5 AM curfew and max 1 passenger under 21 non-family. Full Unrestricted License at age 16½ (Manual: GDL).

Following Distance

Use the 3-second rule: pick a stationary object; when the rear of the vehicle ahead passes it, count "one-thousand-one, one-thousand-two, one-thousand-three." If you reach the object before three, drop back. Increase to 4 seconds on slippery roads, behind motorcycles, with a heavy load or trailer, behind emergency vehicles, approaching railroad crossings, or on hills (Manual: Space Ahead).

Speed Limits

New Mexico defaults (all "unless posted otherwise"): 15 mph within a school zone, 30 mph in business or residential areas, 55 mph on public highways, and 75 mph on rural interstate highways. Always obey the posted sign — it is the maximum allowed (Manual: Speed Limits).

Signal Distance & Turning

Signal at least 100 feet before a turn or lane change. Right on red: permitted after a complete stop unless a sign prohibits it. Left on red: permitted from a one-way street onto another one-way street after a complete stop unless prohibited by a sign. Always watch for pedestrians (Manual: Signals / Intersections).

School Bus Rules

You must stop for a school bus with red lights flashing — whether it is on your side of the road, the opposite side, or at an intersection you are approaching. Only exception: you are not required to stop if the bus is traveling toward you and the roadway is separated by a median or other physical barrier (Manual: Right-of-Way).

Headlights

Use headlights within at least 500 ft when approaching another vehicle. Turn on headlights in rain, snow, or fog — whenever wipers are on. Use low beams within 200 ft when following another vehicle or in heavy traffic. Dim high beams about a one-block distance from oncoming traffic. Do not drive with only parking lights on (Manual: Use Your Lights).

Parking Rules & Distances

Clearances: 15 ft fire hydrant, 25 ft crosswalk at intersection, 30 ft stop/yield sign or traffic signal, 50 ft railroad crossing, 20 ft fire station driveway (same side) / 75 ft opposite side. Parallel-park within 18 inches of the curb. On a hill, turn wheels sharply toward the curb (Manual: Parking).

Child Restraint & Safety Belts

New Mexico law requires all drivers and passengers to use safety belts. Children under 12 must use appropriate safety restraints. Children under 24 months or weighing less than 60 pounds must be secured in an approved safety device. Children should be in the rear seat — never the front passenger side, especially if the vehicle has an air bag (Manual: Safety Belts and Child Restraints).
